In Nachbars Garten stehen Bäume, und deren Blätter fallen ins Wasser der Pool-Besitzerin. Ein Ärgernis, für das eine Frau aus Hessen finanzielle Entschädigung von ihrem Nachbarn verlangt hat. Das Oberlandesgericht (OLG) Frankfurt entschied kürzlich, dass ihr diese nicht zusteht. Die Voraussetzungen für einen Ausgleichsanspruch lägen nicht vor, der Nachbar müsse sich nicht an den Kosten für die Beckenreinigung beteiligen, teilte das OLG am Mittwoch mit.
Auf dem Grundstück des beklagten Nachbarn stehen demnach zwei rund 90 Jahre alte Eichen, die damals ohne Einhaltung des Grenzabstands zum Nachbargrundstück gepflanzt wurden. Die Klägerin kaufte das Nachbargrundstück 2016 und verlangte von ihrem neuen Nachbarn anschließend 277,62 Euro sogenannte monatliche „Laubrente“ für herunterfallende Eicheln und Blätter – beziehungsweise für den Aufwand, den es braucht, um diese aus dem Pool zu fischen.
Auf diese Entschädigung haben Anwohner Anspruch, wenn ihr Grundstück durch Bäume auf dem Grundstück eines anderen Eigentümers ungewöhnlich stark durch Laub beeinträchtigt ist.

Richter: Laubabwurf ist keine wesentliche Beeinträchtigung
Das Landgericht Wiesbaden hatte solch eine Störung durch Laub gesehen und der Frau in erster Instanz im Grunde Recht gegeben. Der beklagte Nachbar ging daraufhin in Berufung – mit Erfolg. Das Oberlandesgericht revidierte die Vorentscheidung im August, wie nun am Mittwoch bekannt wurde (Az.: 19 U 67/23).
Nach Ansicht der Richter des OLG stellt der Laubabwurf keine wesentliche Beeinträchtigung dar. Der erhöhte Reinigungsaufwand für den Pool ist zumutbar. Auch der etwas erhöhte Reinigungsaufwand der Rasen- und Terrassenfläche falle nicht wesentlich ins Gewicht. Und darüber hinaus ließen sich etwa Verstopfungen der Dachrinnen durch preiswerte Laubschutzgitter vermeiden.
Wer den Pool baut, muss ihn auch reinigen
Dass auf den Grundstücken höhere Bäume stehen, wusste die Frau laut Gericht beim Grundstückskauf. „Dass mithin der Pool (…) durch Laub- und Fruchtabwurf der Bäume der Beklagten betroffen sein würde, war sicher zu erwarten“, so das OLG. Entscheide sie sich trotzdem für den Bau eines offenen Pools in unmittelbarer Nähe zu den Bäumen, müsse sie den erhöhten Reinigungsaufwand ohne Entschädigung hinnehmen.
Wo genau sich die Grundstücke befinden, teilte das Gericht nicht mit. Die Belastungen entsprächen der Lage des Grundstücks in einer stark durchgrünten Wohngegend mit vielen Laubbäumen, sagte eine Sprecherin auf Nachfrage des hr.
