Im Kampf gegen Gewalt an Kindern dringt die Missbrauchsbeauftragte der Bundesregierung, Kerstin Claus, auf eine Pflicht zur Speicherung von IP-Adressen. „In Fällen von sexuellem Missbrauch kann der schnelle Zugang zu gespeicherten Kommunikationsdaten entscheidend sein, um Täter und Täterinnen zu identifizieren und Kinder aus akuten Gefahrensituationen zu befreien“, sagte Claus der Deutschen Presse-Agentur.
Wenn Internet- und Mobilfunkanbieter gesetzlich verpflichtet würden, IP-Adressen für einen begrenzten Zeitraum, etwa für 14 Tage, zu speichern, könne dies einen „wichtigen Beitrag zum Kinderschutz leisten“, betonte sie. Bislang gibt es eine solche Pflicht zur einheitlichen Speicherung von Kommunikationsdaten nicht.
Claus unterstützt damit die Position des grünen Justizministers von Nordrhein-Westfalen, Benjamin Limbach, der Anfang der Woche im Gespräch mit dem „Spiegel“ eine entsprechende Initiative im Bundesrat angekündigt hatte. „Wenn unsere Behörden mitbekommen, dass sich Verdächtige übers Internet zu einer schweren Straftat verabreden, sollten sie mit der Zustimmung des zuständigen Gerichts vom Anbieter erfahren, welche Personen sich hinter den IP-Adressen verbergen“, sagte Limbach. Es gehe dabei ausdrücklich darum, IP-Adressen zu sichern und „keine Inhalte, Standorte oder Bewegungsprofile“.
„Keine massive Vorratsdatenspeicherung“
Er hoffe, dass die Bundesregierung den Vorschlag mittrage und der Bundestag das Telekommunikationsgesetz entsprechend ändere, erklärte er. Auch seine Partei habe in dieser Hinsicht ihre ablehnende Haltung geändert. Es wäre „keine massive Vorratsdatenspeicherung“, sondern ein „minimalinvasiver Eingriff“, betonte Limbach.
Claus erklärte, dass der Zugriff auf gespeicherte Daten helfen könne, Kriminelle zu stoppen: Gefährdete Kinder könnten so aus „akuten Missbrauchskonstellationen“ befreit werden. Gerade wenn Ermittlungsbehörden Hinweise auf neues, bisher unbekanntes Material hätten, könne über IP-Adressen der genutzte Rechner identifiziert werden. IP-Adressen seien oft „der einzige Schlüssel, um Kindern schnell und umfassend zu helfen“.
Auch das Bundeskriminalamt (BKA) spricht sich dafür aus. In einem Papier aus dem vergangenen Jahr erklärt das BKA, dass eine Speicherung von IP-Adressen für 14 Tage die Erfolgsquote bei der Identifizierung von Straftätern erheblich steigern könne. Bei einem entsprechenden Test im Jahr 2022 sei die Identifizierungsquote so von 41 Prozent auf 80 Prozent gestiegen. Bislang lehnt das Bundesjustizministerium eine anlasslose einheitliche Speicherung solcher Daten ab. Innenministerin Nancy Faeser (SPD) würde diese dagegen befürworten. Zuletzt hatte es auch im Zusammenhang mit dem mutmaßlichen Terroranschlag von Solingen Forderungen nach einer Neuregelung zur Vorratsdatenspeicherung gegeben.
